LICENSE AND ACCESS
Subject to your compliance with these Conditions of Use and your payment of any applicable fees, Online Traditions or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Online Traditions Services. YOUR ACCOUNT
If you use any Online Traditions Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Online Traditions does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the Online Traditions Services only with involvement of a parent or guardian. Online Traditions reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
Visitors may post reviews, comments, photos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. RISK OF LOSS
All items purchased from Online Traditions are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
RETURNS, REFUNDS AND TITLE
Online Traditions does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. PRODUCT DESCRIPTIONS
Online Traditions attempts to be as accurate as possible. DISPUTES
Any dispute or claim relating in any way to your use of any Online Traditions Service, or to any products or services sold or distributed by Online Traditions or through Online Traditions will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to Network Traditions LLC, #114-182 Arbitration, 13771 N Fountain Hills Blvd, Fountain Hills, Arizona 85268. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
APPLICABLE LAW
By using any Online Traditions Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Arizona, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Online Traditions.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies, such as our Pricing Policy, posted on this site. These policies also govern your use of Online Traditions Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

How to Serve a Subpoena
If you have a subpoena to serve on Online Traditions, please note that Online Traditions does not accept service via e-mail or fax and will not respond to the subpoena. Please note also that providing detailed and accurate information at the outset will facilitate efficient processing of your request. That information will include, for example, e-mail and/or credit card number used to make purchases for retail purchase information; the name, e-mail, and physical address of a seller for seller information; and IP address and complete time stamp for AWS information.
Notice and Procedure for Making Claims of Copyright Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please submit your complaint using our online contact form. We respond quickly to the concerns of rights owners about any alleged infringement. Whether submitting a report in writing or online, please provide us with this information:

ADDITIONAL ONLINE TRADITIONS SOFTWARE TERMS
- Use of the Online Traditions Software. You may use Online Traditions Software solely for purposes of enabling you to use and enjoy the Online Traditions Services as provided by Online Traditions, and as permitted by the Conditions of Use, these Software Terms and any Service Terms. You may not incorporate any portion of the Online Traditions Software into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the Online Traditions Software or otherwise assign any rights to the Online Traditions Software in whole or in part. You may not use the Online Traditions Software for any illegal purpose. We may cease providing any Online Traditions Software and we may terminate your right to use any Online Traditions Software at any time. Your rights to use the Online Traditions Software will automatically terminate without notice from us if you fail to comply with any of these Software Terms, the Conditions of Use or any other Service Terms. Additional third party terms contained within or distributed with certain Online Traditions Software that are specifically identified in related documentation may apply to that Online Traditions Software (or software incorporated with the Online Traditions Software) and will govern the use of such software in the event of a conflict with these Conditions of Use. All software used in any Online Traditions Service is the property of Online Traditions or its software suppliers and protected by United States and international copyright laws.
- Use of Third Party Services. When you use the Online Traditions Software, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.
- No Reverse Engineering. You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the Online Traditions Software, whether in whole or in part, or create any derivative works from or of the Online Traditions Software.
- Updates. In order to keep the Online Traditions Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.
- Export Regulations; Government End Users. You must comply with all export and re-export restrictions and regulations of the Department of Commerce and other United States agencies and authorities that may apply to the Online Traditions Software. If you are a U.S. Government end user, we are licensing the Online Traditions Software to you as a “Commercial Item” as that term is defined in the U.S. Code of Federal Regulations (see 48 C.F.R. § 2.101), and the rights we grant you to the Online Traditions Software are the same as the rights we grant to all others under these Conditions of Use.
Money Back Guarantee/Refund Policy
All merchandise unless otherwise indicated may be returned for a refund within 14 days from the date of delivery to the order shipping address. CPUs may be returned for a refund within 7 days from the date of delivery to the order shipping address. A return authorization number is required for all returns. A 15% restocking fee may apply. Additional deductions may be made for CPU returns to reflect the current market value. These terms apply to all refunds. Most products are shipped with a refund/replacement guarantee period unless otherwise noted in the product listing. Customers must inform Online Traditions of any order discrepancy within 7 days from the date of delivery to the order shipping address so that we may investigate and resolve the situation accordingly.
Online Traditions SATISFACTION GUARANTEE
Online Traditions offers our customers a 14-day satisfaction replacement or refund guarantee on all purchases, except:
- 7-day replacement or refund guarantee on all CPUs, including Open Box processors. All other Open Box merchandise has a 14-day warranty period.
- For CPUs, the base cost will reflect the current market value, and the 15% restocking fee will be applied after this adjustment.
- Downloadable software may not be exchanged or returned for a refund after purchase.
- Marketplace: If you purchase an item from a Online Traditions Marketplace seller and need to return it, you must return that item to the Marketplace seller rather than to Online Traditions. In general, Online Traditions Marketplace sellers will honor Online Traditions’ Money Back Guarantee and Return Policy set forth above. However, certain exceptions may apply. Check the product description and/or the Seller’s Policy Page for return policies of individual products and Marketplace sellers. In the event of a conflict between Online Traditions’ return policies and those on a Seller’s Policy Page and/or product listing, the product listing policies are superior to the Seller’s return polices which in turn are superior to the general policies published herein.
- Grocery items may only be returned for refund within 14 days from the date of delivery to the order shipping address if the packaging is unopened and untampered with. Opened grocery items cannot be returned for refund. If you have opened a grocery item purchase to discover it is unsuitable for consumption, you may exchange the item for a mutually acceptable replacement or refund by contacting Online Traditions Customer Service and acquiring an RMA number.
Online Traditions Return Policies
Marketplace: Online Traditions Marketplace sellers may have software return policies that differ from Online Traditions’ software return policy set forth above. Check the Seller’s Policy Page for the software return policies of individual Marketplace sellers. In the event of a conflict between Online Traditions’ software return policy and those on a Seller’s Policy Page, the Seller’s Policy Page software return polices shall apply to your software orders from that seller.
Out-of-Stock (Back-Order) Items
If Online Traditions no longer carries an item that is sent in for replacement, or if that item is simply out of stock, the item will be sent to our Back-Order RMA Department. You will be notified via email of two options: 1) Online Traditions can send you a comparable replacement item, or 2) Online Traditions can issue you a refund at the current market value of the product. A current-market-value refund may not exceed the original invoice price. If the item is returned within 14 days from the date of delivery to the order shipping address, a full refund will be issued.
Warranties; All Product Sold “AS-IS” or “With All Faults”
ONLINE TRADITIONS IS A DISTRIBUTOR ONLY. PRODUCTS SOLD BY ONLINE TRADITIONS ARE NOT MANUFACTURED BY ONLINE TRADITIONS. THE PRODUCTS MAY, HOWEVER, BE COVERED BY EACH MANUFACTURER’S WARRANTY, SERVICE, AND SUPPORT POLICY (IF PRESENT). ONLINE TRADITIONS ASSIGNS AND PASSES THROUGH TO THE CUSTOMER ANY WARRANTY OF THE MANUFACTURER, AND CUSTOMER ACKNOWLEDGES THAT IT SHALL HAVE RECOURSE ONLY UNDER SUCH WARRANTIES AND ONLY AS AGAINST THE MANUFACTURER OF THE PRODUCTS. ONLINE TRADITIONS MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. ONLINE TRADITIONS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.
ALL ITEMS SOLD THROUGH ONLINE TRADITIONS ARE SOLD “AS-IS” OR “WITH ALL FAULTS.” THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THESE ITEMS IS WITH THE BUYER. SHOULD ANY OF THESE ITEMS PROVE DEFECTIVE, DO NOT FUNCTION, OR FUNCTION IMPROPERLY IN ANY WAY FOLLOWING THEIR PURCHASE, THE BUYER, AND NOT THE MANUFACTURER, DISTRIBUTOR, OR ONLINE TRADITIONS , ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR.
Limitation of Liability
IN ALL CIRCUMSTANCES ONLINE TRADITIONS ‘S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. ONLINE TRADITIONS SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. ONLINE TRADITIONS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT ONLINE TRADITIONS HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
Shipping Charges
Your total cost for purchase of any product will include the shipping and handling charges shown on your Online Traditions invoice. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to Online Traditions.Risk of Loss
Online Traditions will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) — excepting software– and risk of loss passes to the Customer upon delivery to the carrier. Online Traditions reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow Online Traditions to sign appropriate documents on Customer’s behalf to permit Online Traditions to protect its purchase money security interest. Title to software will remain with the licensor(s). All software is provided subject to the license agreement of the software maker. Customer agrees to be bound by any software license agreement once the seal on the package is broken. Online Traditions will advise Customer of estimated shipping dates, but Online Traditions will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.About Shipping Restrictions

About List Prices
Except where noted otherwise, the List Price or Suggested Price displayed for products on any Online Traditions Service represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price or Suggested Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the List Price or Suggested Price may represent “open-stock” prices, which means the aggregate of the manufacturer’s estimated or suggested retail price for each of the items included in the set. Where an item is offered for sale by one of our merchants, the List Price or Suggested Price may be provided by the merchant.
About Shopping Cart Prices
Items in your Shopping Cart will always reflect the most recent price displayed on the item’s product detail page.
This price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart doesn’t reserve the price shown at that time. It is also possible that an item’s price may decrease between the time you place it in your cart and the time you purchase it.

Orders
With respect to items sold by Online Traditions, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the correct price of an item sold by Online Traditions is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.
An order is not binding upon Online Traditions until it is accepted; Online Traditions must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with Online Traditions. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.
We generally do not charge your credit card until after your order has entered the shipping process or, for digital products, until we make the digital product available to you.
Quantity Purchases
While Online Traditions is more than happy to fill your order for a quantity of ten (10) or more of any given item in our inventory on a single purchase order, please understand that an order of that size, once purchase is completed, is automatically non-refundable. All other specific conditions related to the ordered item still apply, including any and all stipulations relative to any available replacement return policies. M.A.P. – Minimum Advertised Pricing Policy
Some manufacturers have a Minimum Advertised Pricing (MAP) policy that we are contractually required to not “advertise” their product below a specific price. This is a required contract with these suppliers for us to resell their products.
There is quite a bit of controversy about what part of an Internet eStore represents an “advertisement” and what part of the eStore is an actual offer to buy or in essence, a “commercial transaction”. Some recent legal rulings by the US Circuit Courts and FTC rulings MAY shed more light upon this subject as they seem to agree that an encrypted shopping cart on a website MAY be construed as an offer to buy and thus a commercial transaction – not applicable to these MAP agreements.
There is currently no mechanism to display the correct discounted pricing in the open on our website within the constraints of our agreement with these manufacturers. Since our “Advertised Pricing” is available on our website to the general public even though our selling prices may be quite lower (much lower in most cases), we have implemented a special secure web site for viewing the ACTUAL prices that we will charge. Once you enter the item into our SSL protected “secure shopping cart”, you are considered to have entered our “online retail storefront” and are no longer on our “advertising website”, therefore the agreement is upheld, but you also see the actual lower pricing.
About Surcharges
Oversized and extremely heavy items will incur a special shipping surcharge.
The surcharge varies depending on the size and weight of the item. This charge will be displayed in the Shipping & Handling subtotal of the order form.
Some items may incur a sourcing fee to cover the expense of selling these items; we regret that we must occasionally pass these costs along to our customers. The sourcing fee, if applicable, will be listed along with the item’s price on the product detail page.
Recordings
Online Traditions does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with Online Traditions unless Customer has provided clear and conspicuous notice to Online Traditions and has received prior written consent from Online Traditions.
Severability
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Arizona law.
Waiver
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party’s right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.
Entire Agreement
These terms and conditions, together with Online Traditions’ invoice regarding the products ordered by Customer, are the complete and exclusive agreement between Online Traditions and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Online Traditions and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

Online Traditions is a trade name enterprise of Network Traditions LLC. “Online Traditions” as used herein refers to Network Traditions LLC. All transactions are with Network Traditions LLC and will appear as “PAYPAL *TRADITIONS” on credit/debit card statements.

If you choose to visit Online Traditions, your visit and any dispute over privacy is subject to this Notice and our Conditions of Use, including limitations on damages, resolution of disputes, and application of the law of the state of Arizona. If you have any concern about privacy at Online Traditions, please contact us with a thorough description, and we will try to resolve it. Our business changes constantly, and our Privacy Notice and the Conditions of Use will change also. We may e-mail periodic reminders of our notices and conditions, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.

Information You Give Us
You provide most such information when you search, buy, post, participate in a contest or questionnaire, or communicate with customer service. For example, you provide information when you search for a product; place an order through Online Traditions or one of our third-party sellers; provide information in Your Account (and you might have more than one if you have used more than one e-mail address when shopping with us) or Your Profile; communicate with us by phone, e-mail, or otherwise; complete a questionnaire or a contest entry form; use our services; compile Wish Lists or other gift registries; participate in Discussion Boards or other community features; provide and rate Reviews; and employ Product Availability Alerts, such as Available to Order Notifications. As a result of those actions, you might supply us with such information as your name, address, and phone numbers; credit card information; people to whom purchases have been shipped, including addresses and phone number; people (with addresses and phone numbers); e-mail addresses of your friends and other people; content of reviews and e-mails to us; personal description and photograph in Your Profile; and financial information, including Social Security and driver’s license numbers.
Automatic Information
Examples of the information we collect and analyze include the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform; purchase history, which we sometimes aggregate with similar information from other customers to create features like Top Sellers; the full Uniform Resource Locator (URL) click stream to, through, and from our Web site, including date and time; cookie number; products you viewed or searched for; and the phone number you used to call a related 800 number. We may also use browser data such as cookies, Flash cookies (also known as Flash Local Shared Objects), or similar data on certain parts of our Web site for fraud prevention and other purposes. During some visits we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page. Mobile
Most mobile devices provide users with the ability to disable location services. Most likely, these controls are located in the device’s settings menu.
